Assumption of Risk
Your participation in any Chingón Legacy program, workshop, event, activity, referral, or service is voluntary. You understand that participation may involve ordinary risks, including personal injury, illness, property loss, business loss, financial loss, travel-related incidents, or interactions with other participants and third parties.

To the fullest extent permitted by law, you voluntarily assume all risks associated with your participation, except to the extent directly caused by conduct for which liability cannot legally be waived.

No Guarantee of Results
Chingón Legacy does not guarantee that using its website, attending a program, receiving a referral, participating in a workshop, or obtaining organizational assistance will result in:

Business formation, growth, profitability, or continued operation.

Approval of a grant, loan, immigration filing, license, permit, benefit, or application.
-
Employment, investment, funding, housing, legal status, or financial improvement.
-
Acceptance into any program or opportunity.
-
A particular educational, personal, professional, or community outcome.
You remain responsible for your own decisions, applications, expenses, business operations, filings, deadlines, and compliance obligations.

Release of Claims
To the fullest extent permitted by applicable law, you release and discharge Chingón Legacy, Inc. and its current and former directors, officers, employees, volunteers, representatives, contractors, sponsors, partners, affiliates, successors, and assigns from claims arising from or connected with:

Your use of the website or its content.

Your participation in programs, workshops, events, or activities.

Information, resources, referrals, or administrative assistance provided by Chingón Legacy.

The actions or omissions of third-party professionals, vendors, venues, organizations, speakers, performers, or service providers.

The loss, theft, or damage of personal property.
-
Decisions you make based on information or resources provided by Chingón Legacy.
This release does not apply to claims that cannot legally be released.

Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CHINGÓN LEGACY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, REPRESENTATIVES, SPONSORS, PARTNERS, AFFILIATES, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES.
THIS INCLUDES LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOST DATA, REPUTATIONAL HARM, EMOTIONAL DISTRESS, OR OTHER LOSSES ARISING FROM OR RELATED TO THE WEBSITE, PROGRAMS, EVENTS, SERVICES, REFERRALS, MATERIALS, OR YOUR RELATIONSHIP WITH CHINGÓN LEGACY.
TO THE FULLEST EXTENT PERMITTED BY LAW, CHINGÓN LEGACY’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF:

The amount you paid directly to Chingón Legacy for the specific product, event, program, or service giving rise to the claim during the six months before the event giving rise to the claim; or
-
One hundred dollars.
These limitations apply regardless of the legal theory asserted and even if Chingón Legacy was advised that damages were possible.
Nothing in these Terms limits liability that cannot legally be limited or excluded.

Third-Party Conduct
Chingón Legacy may provide referrals, links, introductions, locations, speakers, vendors, professionals, community partners, sponsors, or other third-party resources as a convenience.
Chingón Legacy does not control and is not responsible for the conduct, advice, services, products, representations, qualifications, safety practices, privacy practices, or omissions of any third party.
A referral, partnership, sponsorship, link, or appearance at a Chingón Legacy program does not create a guarantee, agency relationship, joint venture, employment relationship, or endorsement unless expressly stated in a written agreement signed by Chingón Legacy.
You are responsible for independently evaluating third-party providers before sharing information, making payments, signing agreements, or relying on their services.

Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Chingón Legacy and its directors, officers, employees, volunteers, representatives, contractors, sponsors, partners, affiliates, successors, and assigns from claims, demands, damages, judgments, liabilities, penalties, losses, and reasonable legal expenses arising from or related to:

Your violation of these Terms.

Your unlawful, negligent, fraudulent, or wrongful conduct.

Information or materials you submit.
-
Your infringement of another person’s intellectual-property, privacy, publicity, contractual, or other rights.

Your participation in an event, program, activity, or transaction.
-
A dispute between you and another participant or third party.
-
Your business, products, services, employees, contractors, customers, or operations.
Chingón Legacy reserves the right to control the defense and settlement of any matter subject to indemnification. You agree to cooperate fully with that defense.

Informal Dispute Resolution
Before filing a lawsuit or commencing arbitration, the person asserting a dispute must send Chingón Legacy a written notice containing:

The person’s full name and contact information.

A detailed description of the dispute.
-
The relevant transaction, program, event, or service.
-
The specific relief requested.
-
Copies of supporting documents.
The parties will have 60 days after receipt of the notice to attempt to resolve the dispute informally.
The notice must be sent by certified mail to Chingón Legacy’s principal business address and by email to info@chingonlegacy.org.
Neither party may begin formal proceedings until this process has been completed, except when immediate injunctive relief is reasonably necessary.

Binding Individual Arbitration
Except for matters that qualify for small-claims court and claims seeking temporary or emergency injunctive relief, any dispute arising from or relating to these Terms, the website, a purchase, donation, membership, program, event, service, referral, or interaction with Chingón Legacy will be resolved through final and binding arbitration rather than a lawsuit in court.
The arbitration will be administered by the American Arbitration Association under the rules applicable to the dispute. The arbitration will take place in Marion County, Indiana, unless applicable law requires another location or the parties agree otherwise in writing.
The arbitrator may award any individual remedy available under applicable law but may not combine claims involving different people without the written consent of all parties.
Judgment on the arbitration award may be entered in any court with jurisdiction.
Nothing in this section prevents Chingón Legacy from seeking injunctive relief to protect its confidential information, intellectual property, operations, website, safety, or legal rights.

Jury-Trial Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND CHINGÓN LEGACY KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE NOT RESOLVED THROUGH ARBITRATION.

Class-Action Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS.
YOU MAY NOT BRING OR PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, CONSOLIDATED ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER PROCEEDING IN WHICH ONE PERSON SEEKS RELIEF ON BEHALF OF ANOTHER.
The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that person’s claim.

Time Limit for Claims
To the fullest extent permitted by law, any claim arising from or relating to the website, these Terms, a transaction, donation, event, program, service, referral, or interaction with Chingón Legacy must be formally filed within one year after the claim arose.
A claim filed after that period will be permanently barred unless applicable law prohibits the use of a shorter contractual deadline.
This provision does not extend any shorter limitation period imposed by law.

Governing Law and Exclusive Venue
These Terms and any dispute involving Chingón Legacy will be governed by the laws of the State of Indiana, without regard to its conflict-of-law rules.
For any dispute that is not required to be arbitrated, the parties consent to the exclusive jurisdiction and venue of the state courts located in Marion County, Indiana, or the federal court with jurisdiction over Marion County, Indiana.
You waive objections based on personal jurisdiction, inconvenient forum, or improper venue to the fullest extent permitted by law.

Chingón Legacy’s Right to Suspend or Terminate Access
Chingón Legacy may refuse service, reject an application, cancel a registration, remove a participant, suspend website access, or terminate participation when it reasonably determines that a person:

Violated these Terms or another organizational policy.

Created a safety, security, legal, financial, operational, or reputational risk.

Submitted false, incomplete, misleading, or fraudulent information.
-
Harassed, threatened, abused, or discriminated against another person.
-
Disrupted an event, program, workplace, or online community.
-
Misused organizational resources, funds, intellectual property, or confidential information.
Except where required by law or a separate written agreement, Chingón Legacy is not required to provide advance notice, an appeal, or a detailed explanation for its decision.

Severability and Reformation
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted and, where allowed, modified only as much as necessary to make it enforceable.
The remaining provisions will continue in full force and effect.

No Waiver
Chingón Legacy’s failure or delay in enforcing any provision does not waive its right to enforce that provision or any other provision later.
A waiver is valid only when it is in writing and signed by an authorized representative of Chingón Legacy.

Entire Agreement
These Terms, together with the Privacy Notice and any additional written terms presented for a particular purchase, program, event, membership, donation, or service, constitute the entire agreement between you and Chingón Legacy concerning the applicable subject matter.
Any separate agreement signed by Chingón Legacy will control if it expressly conflicts with these Terms.

Acceptance of Terms
By accessing the website, creating an account, submitting an application, registering for an event or program, making a purchase or donation, or selecting a box stating that you accept these Terms, you acknowledge that you have had the opportunity to review them and agree to be legally bound by them.
